1.3. By downloading, installing, opening or using the App in any way, you declare that you have read and understood these Terms and agree to be bound by them. If you do not accept the Terms, do not use the App and remove it from your device.
1.4. Together with these Terms, the Privacy Policy for the App forms an inseparable whole. You can access the Privacy Policy at https://global360.studio/tabu360/privacy-policy/en and from within the App.
1.5. If you obtained the App from the Apple App Store, the Apple Media Services Terms and Conditions also apply. If you obtained the App from Google Play, the Google Play Terms of Service also apply. In the event of a conflict between these Terms and the mandatory conditions of the store operator, the store operator's mandatory conditions prevail.
1.6. The App is rated 4+ (App Store) / "Everyone" (Google Play) and is suitable for all ages. If you are under the age of majority in your country, you may use the App with the knowledge of a parent or guardian, who accepts these Terms on your behalf to the extent the law requires. The only purchase in the App is the optional one-time "Remove Ads" item described in Section 6; any purchase by a minor must be made with the consent of a parent or guardian, who can supervise purchases with Apple's Ask to Buy or Google Play's purchase controls.
2. Definitions
- "App": the mobile game software named Tabu360, together with all of its updates, versions and components, on iOS and, where offered, Android.
- "Content": all imagery, illustrations, logos, texts, word cards (main words and forbidden words) in every language, sound effects, music, fonts, interface designs and software code contained in the App.
- "User": the natural person who downloads and/or uses the App.
- "Remove Ads Purchase": the optional, one-time, non-consumable in-app purchase that permanently switches off advertising in the App for the store account that bought it.
- "Store": the Apple App Store or Google Play, whichever you obtained the App from.
- "Apple": Apple Inc. and, for content acquired through the App Store in your territory, Apple Distribution International Ltd. (Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland).
- "Google": Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and Google Ireland Limited, as operator of Google Play.
3. Nature of the Service
3.1. The App is a word-guessing party game played by teams in the same physical space, taking turns on a single device. In each turn, one player of a team holds the device and describes the main word on the card to their teammates without using the word itself or any of the five forbidden words printed under it, while a timer runs. A correct guess earns a point, using a forbidden word costs a point, and a limited number of cards may be passed. After the chosen number of rounds, the team with the most points wins. The purpose of the game is entertainment.
3.2. The game itself works offline. No membership, account creation or personal data is required to play. An internet connection is used only to display advertisements in the free version and to process or restore the Remove Ads Purchase. The App contains 25,000 word cards in five languages (Turkish, English, German, French, Spanish), all of which are included in the App itself.
3.3. The App is free to download, and the full game — every card, every language, every setting — is available free of charge. The free version is supported by advertising (Section 6.2). A single optional purchase, the Remove Ads Purchase, is offered (Section 6.3); there are no subscriptions, no virtual currency and no other paid content.
3.4. The App is an entertainment product offered "as is"; it is not an education, language-learning, consultancy, betting or prize service. No real money can be won in the App; scores have no value outside the game.
4. Licence
4.1. Provided that you comply with these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the App solely for personal and non-commercial purposes on devices that you own or control: on Apple-branded devices as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, and on Android devices as permitted by the Google Play Terms of Service.
4.2. Personal and non-commercial use includes playing the App at home, at gatherings with friends and family, in classrooms and at private events. Using the App as part of a paid event, tournament or commercial service requires our prior written permission.
4.3. The App is not sold to you, it is only licensed. All rights not expressly granted in these Terms belong to the Company.
5. Rules of Use and Prohibitions
When using the App you agree NOT to do the following:
- a) copy, modify, adapt, translate, create derivative works from, decompile or reverse engineer the App, or attempt to obtain its source code (save where expressly permitted by applicable law);
- b) extract, copy, scrape or reproduce the word cards or any other Content, in whole or in substantial part, for use outside the App — including to build another game, a word list, a dataset or a training corpus;
- c) rent, sell, distribute, publish, sublicense or transfer the App or the Content to third parties;
- d) circumvent, disable or interfere with the App's security measures, purchase validation or advertising systems;
- e) use the App for any unlawful purpose;
- f) use the App's name, brand or Content in other products or services without permission;
- g) use or export the App in breach of applicable export control legislation.
6. Price, Purchases and Advertising
6.1. The game is free
Downloading, installing and playing the full game costs nothing. No payment method is requested to play, and no charge can be made to your Store account without your express confirmation of the single purchase described in Section 6.3.
6.2. Advertising in the free version
- a) In the free version, advertisements are shown through Google AdMob as full-screen interstitials after every two completed games. No advertisement interrupts a round in progress.
- b) The content of advertisements is the responsibility of the relevant advertisers; we give no representation or warranty regarding the products and services advertised. Your transactions on third-party sites and apps that you reach through advertisements are your own responsibility.
- c) You can remove advertising permanently with the Remove Ads Purchase.
- d) For details of advertising-related data processing, including how to grant, refuse or withdraw permission for personalised advertising, see Sections 3.4, 5, 6 and 11 of the Privacy Policy.
6.3. The Remove Ads Purchase
- a) Nature. The Remove Ads Purchase is a one-time, non-consumable in-app purchase. It is NOT a subscription: it does not renew, there is no recurring charge, and there is nothing to cancel. Once bought, it permanently switches off advertising in the App for the Store account that bought it.
- b) The seller. The purchase is not made from the Company. For purchases through the App Store, Apple Distribution International Ltd. is the merchant of record in your territory and Apple acts as agent for the Company as the content provider; for purchases through Google Play, Google is the merchant of record. Your contract of sale for the purchase is therefore concluded with the Store operator, while the licence to use the App is granted to you by the Company under these Terms.
- c) Payment. The purchase is made through the Store using the payment method linked to your Apple ID or Google account, and is charged upon your confirmation of the purchase in the Store's own payment sheet.
- d) Price. The price is displayed to you in your local currency, in the App and in the Store's payment sheet, before you confirm. Prices are set per Store territory and may differ by country, exchange rate and tax; the price displayed at the moment of purchase is the binding price of that purchase. The App never displays a price other than the one supplied by the Store.
- e) Effect and restoring. After the purchase, no advertisement is shown and the advertising software is never started. The purchase is linked to your Store account, not to the device: if you change device or reinstall the App, you can restore it free of charge with "Restore purchases" in the App's Settings, as long as you are signed in with the same Store account.
- f) Refunds. Refund requests are subject to the Store operator's refund policies and must be submitted to the Store operator: Apple — https://reportaproblem.apple.com · Google Play — through the Google Play refund process. Because the Store operator is the merchant of record and the payment infrastructure lies entirely with it, we are not able to issue refunds ourselves. We will, however, support any reasonable refund request you make to the Store operator if you write to us.
- g) Withdrawal rights. Your statutory withdrawal or cancellation rights as a consumer are reserved. The Remove Ads Purchase is digital content supplied immediately after your confirmation; where the law of your country provides that the right of withdrawal is lost once the supply of digital content has begun with your express consent and acknowledgement, the Store's purchase confirmation collects that consent and acknowledgement. The conditions for exercising a withdrawal right are governed by the law of your country and by the Store operator's terms of sale, which are the terms of the contract of sale.
- h) Discontinuation. If the App is ever withdrawn from the Store, a copy already installed on your device continues to work, with advertising switched off, for as long as your operating system supports it.
6.4. Future paid content
Should we in future decide to offer other optional paid content (for example additional word packs), we will do so only by publishing an updated version of these Terms and of the Privacy Policy in accordance with Section 14, at least 30 days before the change takes effect, and in full compliance with the rules of the relevant Store. The core game as it exists on the date of these Terms, and the effect of a Remove Ads Purchase already made, will not be taken away from users who already have them.
7. Updates and Availability
7.1. We may release updates to the App from time to time to fix errors, add words or languages, improve performance or keep the App working on new operating system versions. Updates are delivered through the Store and may be installed automatically depending on your device settings.
7.2. We are not obliged to provide updates, new features or support for any particular period, but see Section 10.3 for your statutory rights as a consumer.
7.3. Because the game works offline, the availability of the game on your device does not depend on any server of ours; only advertisements and the Remove Ads Purchase depend on the Store operator's and Google's services. The App may nevertheless stop working on operating system versions that are no longer supported by the platform vendor.
8. Intellectual Property Rights
8.1. All intellectual and industrial property rights in the App and the Content (including copyright, trade mark rights, design rights and know-how) belong to the Company or are used under licence, and are protected by the relevant legislation and international conventions.
8.2. The word cards in the App — the main words and the forbidden words for each of them, in all five languages — were created by and for the Company and constitute a protected collection. The name "Tabu360", the "TABU 360" logo and the App's visual design are distinctive signs of the Company; they may not be used without written permission.
8.3. The word-guessing game mechanic with forbidden words is a long-established genre of party game and is not itself claimed by the Company. Tabu360 is an independent product of the Company. It is not affiliated with, endorsed by or sponsored by any publisher of board or card games, and any third-party trade marks that may be associated with similar games belong to their respective owners.
8.4. Under these Terms you are granted only the limited licence of use defined in Section 4, and no intellectual property right is transferred.
8.5. The App uses the typefaces "Baloo 2" and "Nunito", which are licensed under the SIL Open Font License 1.1. The App's other components are used under their respective open-source licences; a list is available on request.
8.6. Suggestions, feedback and ideas you send us about the App — including proposed words or corrections to word cards — ("Feedback") are not considered confidential information; we may freely use Feedback for product development purposes without any fee or obligation towards you. This does not affect any personal data contained in your message, which is handled under the Privacy Policy.
9. Third-Party Services
9.1. The App operates together with third-party services: the Store, the iOS or Android operating system and, in the free version, Google AdMob. Those services are subject to their own terms and policies; we do not undertake that they will operate uninterrupted or error-free.
9.2. You agree to comply with applicable third-party terms of agreement when using the App.
9.3. Advertisements shown in the free version may lead to third-party websites or apps; we are not responsible for their content, and your dealings with them are your own responsibility. Beyond advertisements, the App contains no links to third-party websites and no integration with social networks.
10. Disclaimer (Limitation of Warranties)
10.1. To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE". No express or implied warranty is given that the App will be uninterrupted, error-free, secure or fit for a particular purpose.
10.2. Disruptions arising from device compatibility, behavioural changes following operating system updates, Store outages and similar situations fall outside the scope of any warranty.
10.3. Consumers' rights arising from applicable mandatory legislation are reserved and are not affected by this section. In particular, if you are a consumer in the European Union, your rights under Directive (EU) 2019/770 on contracts for the supply of digital content and digital services — including the right to have non-conforming digital content brought into conformity, to a price reduction or to terminate the contract — remain fully available to you to the extent that Directive applies. If you are a consumer in Türkiye, your rights under Law No. 6502 in respect of defective goods and services are reserved.
10.4. Word content. The word cards are written by people and reviewed for a general audience, but with 25,000 cards in five languages an individual card may still strike a particular player as difficult, unfamiliar, dated or unsuitable. We give no warranty as to the completeness, accuracy or suitability of any individual card, and we welcome reports at contact@global360.studio.
11. Limitation of Liability
11.1. To the maximum extent permitted by applicable law, the Company cannot be held liable for indirect, incidental, special, punitive or consequential damages (including loss of profit, loss of data, loss of reputation, loss of in-game progress) arising from the use or inability to use the App.
11.2. Subject to Section 11.3, the Company's total liability under this Agreement is limited to the greater of (i) the total amount you actually paid for the Remove Ads Purchase through the Store in the 12 (twelve) months preceding the event giving rise to the claim, and (ii) EUR 100 or its equivalent in your local currency.
11.3. Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited. This includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, liability under mandatory product liability legislation, and any liability towards consumers that mandatory law does not permit to be limited. If you are a consumer, this Section 11 applies only to the extent that the applicable mandatory consumer law allows.
11.4. The game is based on social interaction between people in the same room; the Company is not responsible for situations that may arise from arguments, disagreements or other interactions between players.
11.5. The App keeps the screen awake while a round is being played. You are responsible for your device's battery and for putting the device down safely; the device is intended to be held by the describing player and should not be used while driving or in any situation requiring your attention.
12. Indemnity
You agree to indemnify and hold the Company harmless in respect of third-party claims, damages, costs and reasonable legal fees arising from your breach of these Terms or your unlawful use of the App. If you are a consumer, this obligation applies only to the extent that you are at fault and only to the extent permitted by the mandatory law applicable to you.
13. Term and Termination
13.1. These Terms enter into force the moment you first use the App and remain in force until terminated by you or by the Company.
13.2. You may terminate the Agreement at any time by removing the App from your device. The Remove Ads Purchase is linked to your Store account, not to the installation, and can be restored if you reinstall the App later. There are no subscriptions, so nothing else needs to be cancelled.
13.3. If you materially breach these Terms, we may terminate your licence, giving you notice and, where the breach is capable of being remedied and you are a consumer, a reasonable opportunity to remedy it first. Upon termination, the provisions of Sections 8, 10, 11, 12, 15, 18 and 19 remain in force.
13.4. We reserve the right to discontinue development, distribution or support of the App at any time. Because the game works offline, a copy already installed on your device will continue to work for as long as your operating system supports it, and a Remove Ads Purchase already made keeps its effect on that copy.
14. Changes to the Terms
14.1. We may update these Terms where there is a valid reason to do so — for example a change in the law, a change in the features of the App, a change in the Stores we distribute through, or the correction of an error. The current text is always published at https://global360.studio/tabu360/terms-of-use/en and the "Last updated" date is revised.
14.2. Where a change materially affects your rights or obligations, we will publish it at least 30 days before it takes effect and will identify what has changed. During that period you remain free to reject the change by ceasing to use the App before the change takes effect. Changes that do not affect your rights — corrections of wording, updated links, clarifications — take effect on publication.
14.3. We will never treat your continued use of the App as acceptance of a change that mandatory consumer law requires you to accept expressly.
15. Governing Law and Dispute Resolution
15.1. These Terms are governed by the laws of the Republic of Türkiye, excluding its conflict of laws rules.
15.2. The İzmir Courts and Enforcement Offices of the Republic of Türkiye, being the courts of the Company's registered office, have jurisdiction over disputes arising from these Terms.
15.3. Consumers. Nothing in Sections 15.1 and 15.2 deprives you of the protection of the mandatory consumer law of your country of residence, or of the right to bring proceedings in the courts of the place where you live. If you are a consumer resident in Türkiye, you may in addition apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or to the Consumer Court of the place where you live, in accordance with Article 73 of Law No. 6502.
15.4. Alternative dispute resolution. The European Commission's Online Dispute Resolution platform was permanently discontinued on 20 July 2025 by Regulation (EU) 2024/3228 and is no longer available. Consumers resident in the European Union may instead contact the European Consumer Centre in their own country, whose details are published at https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution — or use a competent national alternative dispute resolution body. We are not obliged to participate, and do not undertake to participate, in dispute resolution proceedings before a consumer arbitration board; this statement does not affect your right to bring proceedings before the competent courts or, in Türkiye, before the Consumer Arbitration Committee under Section 15.3.
15.5. Before starting any formal proceedings, we ask that you write to contact@global360.studio so that we can try to resolve the matter directly. This is a request, not a precondition, and it does not affect any of your rights or any time limit that applies to you.
16. General Provisions
16.1. Severability: if any provision of these Terms is deemed invalid or unenforceable, this does not affect the validity of the remaining provisions; the invalid provision is deemed replaced by the valid provision closest to its purpose.
16.2. No waiver: the Company's failure to exercise, or delay in exercising, any right does not mean that it waives that right.
16.3. Assignment: you may not transfer your rights and obligations under these Terms without the Company's written consent. The Company may transfer this Agreement in the context of a merger, acquisition or asset sale, provided that your rights under this Agreement are not reduced as a result and that you are informed by reasonable means.
16.4. Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between the parties on the subject matter.
16.5. Language: see Section 0 for language versions and which version applies.
16.6. Force majeure: the Company cannot be held liable for delays in performance or disruptions arising from events beyond its reasonable control, such as natural disasters, war, epidemics, large-scale internet outages and legislative changes.

18. Apple-Specific Provisions
This section applies if you obtained the App from the Apple App Store and is included in accordance with Apple's "Instructions for Minimum Terms of Developer's End-User License Agreement".
18.1. Parties to the agreement. This Agreement is concluded between the User and the Company only; Apple Inc. is not a party to it. The Company alone is responsible for the App and its content.
18.2. Scope of licence. The licence granted in Section 4 is limited to use of the App on Apple-branded products that the User owns or controls, in accordance with the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the User via Family Sharing or volume purchasing.
18.3. Maintenance and support. The Company alone is responsible for providing any maintenance and support services in respect of the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the App.
18.4. Warranty. In the event of any failure of the App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price of the App, if any (the App is free of charge). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty will be the Company's sole responsibility.
18.5. Product claims. The Company, not Apple, is responsible for addressing any claims of the User or any third party relating to the App or the User's possession and/or use of the App, including but not limited to (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
18.6. Intellectual property claims. In the event of any third-party claim that the App or the User's possession and use of the App infringes that third party's intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
18.7. Legal compliance. The User represents and warrants that (i) they are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) they are not listed on any U.S. Government list of prohibited or restricted parties.
18.8. Third-party terms. The User must comply with applicable third-party terms of agreement when using the App.
18.9. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and upon the User's acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against the User as a third-party beneficiary.
18.10. Contact. For any questions, complaints or claims with respect to the App, please contact: 360 GLOBAL STUDIO YAZILIM VE TEKNOLOJİ ANONİM ŞİRKETİ, Adalet Mahallesi, Manas Bulvarı, Folkart Towers, No: 39, Suite 2511, Bayraklı, 35530 İzmir, Türkiye — contact@global360.studio — +90 545 827 2360
19. Google Play-Specific Provisions
This section applies if you obtained the App from Google Play.
19.1. Google is not a party to this Agreement and has no responsibility for the App or its content. The Company alone is responsible for the App, for its maintenance and support, and for any claim relating to it.
19.2. Your use of Google Play is governed by the Google Play Terms of Service. Where the Google Play Terms of Service grant you rights that are broader than these Terms (for example in respect of refunds, which do not arise for a free app), the Google Play Terms of Service prevail to that extent.
19.3. The Company's declarations in the Google Play Data safety section reflect the practices described in the Privacy Policy: no data is collected or shared.
These Terms of Use came into force on 15 September 2026. Related document: Privacy Policy: https://global360.studio/tabu360/privacy-policy/en
